Roskoski is asking a district court in Duluth to set aside the assessment or else order a reassessment because he claims the city violated state law in its assessment process. Roskoski had formally objected to the assessment before the City Council approved it. Attorneys for the city reject Roskoski's claims. They are also attempting to get the case moved from Duluth to Virginia. Roskoski's appeal claims, among other things, that the assessments against individual property owners are improper because the city already receives state funding for the project.
