Test Changes

One Minnesota county is changing the way it tests suspected drunk drivers.

Individuals stopped under suspicion of drinking and driving in Hubbard County will either have to urinate into a cup or give an on the spot blood sample, if they fail a field sobriety test.

The county has decided to eliminate the use of the “Intoxilyzer 5000” breathalyzer due to state wide ruling by the supreme court, giving subjects told to blow, the right to ask for the machine's source code.

Police do not have access to these codes, therefore allowing the suspected drunk driver or court systems to question the accuracy of the breathalyzer and creating a huge loophole.

Douglas County currently uses the “Intoxilyzer 5000' and isn’t considering making a change at this time.

According to the Department of Public Safety, 80% of DWI cases involve the use of the intoxilyzers.
